Scope and Acceptance of Terms of Service
These Terms of Service (“Terms of Service”) govern your use of the products and services offered by Trackstack Inc. and its affiliates, service providers, successors, and assigns (collectively, except where noted, “Trackstack”, “we”, “our”, or “us”).
You agree to these Terms of Service by: (i) expressly acknowledging and accepting them through use of Trackstack’s products and services (e.g., during the process of registering for a Trackstack account or utilizing a Trackstack service); (ii) accessing or using the website located at www.trackstack.app and any subdomains thereof (“Site”); and/or (iii) accessing or using Trackstack’s inbox platform or related tools (“Platform”), which may be accessed via the Site or through integrations with third-party platforms. If you do not agree to these Terms of Service, you should exit the Site and/or Platform and refrain from using any of Trackstack’s products or services.
For simplicity, references to the Site, Trackstack’s products and services, and any associated applications or tools, including the Platform, are collectively referred to in these Terms of Service as the “Services.” If you are accessing the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms of Service, and the terms “User” (or “you” and “your” as appropriate) will refer to both that entity and you as an individual.
The Services are operated by Trackstack. By expressly accepting these Terms of Service, you signify that you have read, understand, and agree to be bound by them. To the extent permitted by law, you also accept these Terms of Service by continuing to access or use the Site, Platform, or any other Services after these Terms of Service have been made available to you, whether by hyperlink or other reasonable means.
In addition to these Terms of Service, you may enter into other agreements with us or our affiliates that govern your use of specific aspects of the Services, such as agreements relating to premium features or other value-added offerings (collectively, “Other Trackstack Agreement(s)”). If there is any conflict between these Terms of Service and any Other Trackstack Agreement, the terms of the Other Agreement will govern in relation to the specific aspects of the Services to which it applies.
As part of the Services, Trackstack may provide you with analytics, estimates, or insights. These are intended solely for informational purposes and are based on our proprietary methodology, assumptions, and available data. Trackstack reserves the right to modify, update, or discontinue such analytics or methodologies at any time and at its sole discretion.
The Services are intended for use primarily within the United States and the United Kingdom. Trackstack makes no representation or warranty that the Services are appropriate or available in other jurisdictions. We reserve the right to limit or restrict access to the Services for any individual, geographic area, or jurisdiction, at any time and in our sole discretion.
If you are using the Services in the United Kingdom, additional terms outlined in the “Local Law Amendments; United Kingdom” section of these Terms of Service will also apply.
Changes to These Terms of Service
We may modify these Terms of Service from time to time, including by adding or removing terms or updating existing provisions. Changes may address your or our rights in the event of a dispute, or reflect updates to the functionality or features of the Services. If changes are made, we will post the revised Terms of Service on the Site and indicate the date of the most recent update at the top of this page. If the changes are materially adverse to you or required by applicable law, we will notify you through reasonable means, such as email or an in-platform notification. If you do not agree to any modified terms, you must contact us to terminate your account before the effective date of the changes. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms of Service.
Consequences of violating terms
If you violate any of these Terms of Service or any Other Pipe Agreement, Pipe may terminate your access and use of Services, and delete your account and any content, data, or information that you have posted on the Services and/or prohibit you from using or accessing the Services (or any portion, aspect, or feature of the Services), at any time in its sole discretion, with or without notice.
